Terms & Privacy.

The agreement between Outta the Weeds, LLC (“we”) and visitors / clients of Project Pulse Check.

§ 01

Acceptance of Terms

By accessing projectpulsecheck.com or using the Project Pulse Check assessment, you agree to these terms. If you do not agree, please do not use the service. We may update these terms from time to time and will note the date of the most recent revision at the bottom of this page.

§ 02

Use of the Service

Project Pulse Check is provided to you, the named purchaser, for your use in evaluating and improving a specific project within your organization. The service is intended for businesses located in the United States. You agree to provide accurate information when identifying interview participants, and to participate honestly in any interview you complete.

§ 03

The Phone Conversation

The assessment is conducted by an automated, AI-powered voice agent that places an outbound phone call to the number you provide. By submitting your phone number and choosing to proceed, you give your express consent to receive this automated call at the time you select. The conversation is transcribed to text so that we can analyze it and prepare your report; we do not retain an audio recording of the call. The AI discloses at the start of the call that the conversation is being transcribed, and you may end the call at any time.

§ 04

Confidentiality

Each interview is conducted one-on-one; no one else listens. Interview content is encrypted in transit and at rest. The report describes patterns and dynamics, not quotes attributed to specific individuals, and every participant remains anonymous within the report, whether by name or by role. The completed report is delivered only to the named purchaser. We do not disclose your company information, project details, or interview content to vendors, consultants, or any other third parties.

§ 05

Privacy & Data Protection

We collect only what we need: the intake details you submit (name, email, phone, company) and the transcript of your interview, used solely to deliver and support your engagement. We rely on a small set of trusted service providers to operate the service — GoHighLevel (intake forms and CRM), Twilio (telephony for the call), Vapi (the AI voice conversation), and Stripe (payment processing) — and each receives only the information it needs to perform its function. We do not sell or rent your data to anyone, and we do not use third-party advertising trackers. We retain your interview transcript only as long as needed to prepare, deliver, and support your report, and no longer than ninety (90) days after delivery, after which it is deleted. You may request deletion of your data at any time by contacting us.

§ 06

Payments & Refunds

The Comprehensive Pulse Check fee is $2,997 USD, paid in full via Stripe at the time of purchase. You may cancel for a full refund at any time before your first interview begins — you can do this yourself from your progress page. Once interviews begin, the engagement is underway and the fee is non-refundable. If a technical failure on our side prevents us from delivering the engagement, we refund your payment in full.

§ 07

Intellectual Property

All Project Pulse Check pattern names, descriptions, analytical frameworks, and methodologies are proprietary intellectual property of Outta the Weeds, LLC. The completed report is licensed for your internal use within your organization, including sharing with consultants you engage to assist with implementation. You may not republish, redistribute, or resell the report or its contents.

Disclaimers & Limitations

Project Pulse Check provides intelligence and recommendations based on interview analysis. Outcomes depend on your implementation of the recommendations, your organizational context, and factors outside our control. We make no guarantees regarding project success or specific business outcomes. The report is not legal, financial, or compliance advice. To the fullest extent permitted by law, our total liability arising from the service is limited to the amount you paid for it.

§ 09

Governing Law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws provisions. Any dispute arising from these terms or from your use of the service will be resolved in the state or federal courts located in Ohio.
