1. ACCEPTANCE OF TERMS

By accessing or using Project Pulse Check (the "Service"), provided by Outta the Weeds LLC ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

Age Requirement: You must be at least 18 years of age to use this Service. By using the Service, you represent that you are 18 or older.


2. SERVICE DESCRIPTION

Project Pulse Check provides transformation readiness assessments through AI-powered stakeholder interviews. Services include:

  • Free Pulse Check: 30-minute preliminary consultation

  • Full Assessment: 10 confidential stakeholder interviews and comprehensive readiness report


3. PAYMENT & REFUND POLICY

Payment Terms:

  • Full payment required upfront before stakeholder selection begins

  • Payment processed via Stripe through our secure checkout

No Refund Policy:

  • All sales are final

  • Work begins immediately upon purchase

  • No refunds will be provided except in cases of technical failure preventing service delivery

Technical Failure Definition: Technical failure means our platform's inability to complete the purchased interviews due to system malfunction, not user scheduling issues or non-participation.


4. USER RESPONSIBILITIES

As the Purchaser, you agree to:

  • Provide accurate contact information for all interview participants

  • Ensure management participants identify frontline candidates within specified timeframes

  • Respond to time-sensitive communications regarding participant non-response

  • Understand that interview quality depends on participant honesty and engagement

Participant Cooperation: You acknowledge that assessment quality requires:

  • Timely participant scheduling and completion of interviews

  • Honest, thoughtful responses during interviews

  • Full cooperation from designated stakeholders

We are not responsible for assessment delays or quality issues resulting from participant non-cooperation, scheduling conflicts, or incomplete responses.


5. CONFIDENTIALITY & DATA SECURITY

Our Commitment:

  • All interview data is encrypted and stored securely

  • Individual interview transcripts are never shared with the purchaser

  • Reports use pattern-based attribution only, not individual quotes

  • Frontline participants remain anonymous through random selection process

  • No data is shared with third parties

Data Access:

  • Interview data is accessible only to our analysis systems

  • Reports are delivered only to the purchaser

  • You control who within your organization sees the final report

Data Retention:

  • Interview data is retained for 90 days after report delivery

  • Data can be deleted upon request

  • Anonymized pattern data may be retained for research purposes


6. PRIVACY POLICY

Information We Collect:

From Purchasers:

  • Name, email, company name, phone number

  • Payment information (processed securely through Stripe)

  • Transformation project details

From Interview Participants:

  • Name, email, role

  • Interview responses (voice and transcript)

  • Scheduling preferences

How We Use Information:

  • To deliver the purchased assessment services

  • To conduct and analyze interviews

  • To generate readiness reports

  • To improve our services

  • To communicate about your assessment

We Do NOT:

  • Sell your data to third parties

  • Use your data for marketing to others

  • Share interview content outside our analysis system

  • Disclose participant identities in reports (frontline remain anonymous)

Cookies & Tracking: We use essential cookies for:

  • Website functionality

  • Secure authentication

  • Analytics to improve user experience

7. YOUR PRIVACY RIGHTS

For All Users: You have the right to:

  • Access your personal data

  • Request correction of inaccurate data

  • Request deletion of your data (subject to assessment completion requirements)

  • Opt out of non-essential communications

  • Request data portability

For European Union Residents (GDPR): In addition to the rights above, you have the right to:

  • Restrict processing of your data

  • Object to processing of your data

  • Withdraw consent at any time (where processing is based on consent)

For Users Outside the United States: Your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using our Service, you consent to the transfer of your information to the United States.

We implement appropriate safeguards for international data transfers, including:

  • Standard contractual clauses approved by the European Commission

  • Encryption of data in transit and at rest

9. DO NOT SELL MY PERSONAL INFORMATION

California Residents: We do not sell personal information as defined under the California Consumer Privacy Act (CCPA). We have not sold personal information in the past 12 months.


10. INTELLECTUAL PROPERTY

Our Property: All content, including:

  • Pattern frameworks and names

  • Assessment methodologies

  • Analysis algorithms

  • Report templates

  • Website content

Your Report: You receive a license to use your specific assessment report internally within your organization. You may not:

  • Resell or redistribute the report

  • Publish the report publicly without our written consent

  • Reverse-engineer our methodology

  • Use our pattern framework for commercial purposes


11. LIMITATION OF LIABILITY

Service Provided "As Is": We provide professional analysis based on interview data, but:

  • We cannot guarantee specific outcomes or project success

  • We are not responsible for decisions made based on our recommendations

  • Assessment quality depends on participant honesty and engagement

Maximum Liability: Our total liability for any claim related to the Service is limited to the amount you paid for the assessment.

Not Liable For:

  • Indirect, incidental, or consequential damages

  • Lost profits or business opportunities

  • Decisions made based on assessment findings

  • Participant non-cooperation or scheduling issues

  • Third-party actions


12. DISCLAIMER OF WARRANTIES

We provide the Service "as is" without warranties of any kind. We do not warrant that:

  • The Service will be uninterrupted or error-free

  • Results will meet your expectations

  • Interview participants will respond honestly

  • Our recommendations will resolve all project issues


13. INDEMNIFICATION

You agree to indemnify and hold harmless Outta the Weeds LLC from claims arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Actions of your interview participants


14. DISPUTE RESOLUTION

Governing Law: These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Arbitration: Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Cincinnati, Ohio.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations.


15. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of modified Terms.

Material changes will be communicated via email to registered users.


16. TERMINATION

We reserve the right to:

  • Refuse service to anyone

  • Terminate access for Terms violations

  • Modify or discontinue the Service

Upon termination:

  • No refunds will be provided

  • You must cease use of all materials

  • Confidentiality obligations survive


17. MISCELLANEOUS

Entire Agreement: These Terms constitute the entire agreement between you and Outta the Weeds LLC.

Severability: If any provision is found unenforceable, remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not assign these Terms. We may assign them without notice.
